Rules & Regulations

I. Definitions

Apartments4u Systemonline reservation system run by APARTMENTS4U.PL SP. Z O.O., company registered in Poland with the seat in Poznan on ul.Wyspiańskiego 26b/114, Regon 302397890, NIP: 779-241-28-44. In the following Rules and Regulations, the name Apartments4u also refers to APARTMENTS4U.PL SP. O.O.

Accommodation facility – tourist facilities of an accommodation type offered to be rented by the owner in the Apartments4u system.

Client – recipient of the service of the renting of the accommodation facility presented in the Apartments4u system.

Owner – business entity being the owner of the accommodation facility contained in the Apartments4u offer. 

Caretaker of the facility – a person appointed by the owner of the facility in the Apartments4u system to provide full service of his/her accommodation facility and also responsible for a proper contact with the client and handover of keys.

Reservation – agreement made between the client and the owner of the accommodation facility including only the renting of the accommodation facility.

Additional services – services offered as an option for an additional charge offered by the owner of the accommodation facility the information of which is to be found by every accommodation facility.

'On request’ services – these are not usually part of the offer of a certain accommodation facility. In order to gain access to them, the conditions of using them should be agreed with the owner.

Total price of reservation – gross amount which the client must pay for renting the accommodation facility for a period of time determined by him/her. This price does not include other charges for additional services chosen by the client from the optional list of additional services offered by the owner.

Reservation season – the calendar year is divided into seasons (periods) for which the owner has a right to determine certain price for renting.

Advance payment – gross amount determined in percentages from the total price for a reservation being a part of it, which the client has to pay to the Apartments4u while doing the reservation in the Apartments4u system.

Voucher – a document sent to the client via email after the acceptance of the reservation by the Apartments4u system, in which all necessary information concerning the reservation are to be found. This document is also a confirmation of reservation and has to be shown to the owner during the handover of keys to the accommodation facility.

II. General Provisions

  1. The following Rules and Regulations determine the conditions of use and making reservations in the Apartments4u reservation system. Making reservations in the Apartments4u system means full acceptance of all conditions described in the Rules and Regulations.
  2. All information of accommodation facilities including the price offer for renting is open information available to all through the Apartments4u internet portal by the accommodation facility to which it relates.
  3. Data and information concerning the accommodation facilities as well as prices placed in the Apartments4u system are not a commercial offer as defined by the Civil Code.
  4. A client who decides to make a reservation of a certain accommodation facility accepts all conditions and features of the accommodation facility given in its description.
  5. Apartments4u reserves a right to introduce changes to the Rules and Regulations through a publishing of its actual form in the Apartments4u system, at the same time each owner cooperating with the Apartments4u system will receive certain information concerning such changes. In case of the lack of acceptance of introduced changes, the owner has a right to terminate the agreement with Apartments4u system. He will not be however exempted from meeting the conditions of the agreements concluded with clients before the termination of the agreement.
  6. Apartments4u reserves a right to modify the system and delete certain elements of the system, its features and types of available options in the situation when the legal, technical or economic circumstances require such actions to be taken. If it’s necessary, the Apartments4u can also limit the access to certain or all information contained in the Apartments4u system in the same circumstances.
  7. Due to technical reasons, interruptions in the access to the Apartments4u system are possible at the same time Apartments4u ensures that it will spare no effort to minimize such interruptions. Apartments4u is not able to guarantee constant access to the Apartments4u system.
  8. Apartments4u is not a side in agreements concluded between clients and owners of accommodation facilities; it is also not the owner of any accommodation facilities offered in the Apartments4u system. The online Apartments4u reservation system is only an environment enabling the presentation of offered accommodation facilities put by their owners and making of on-line reservations by the clients.
  9. The only part in the financial transaction between the client and the owner of the accommodation facility is the imposition on the owner of the accommodation facility a commission for the use of the Apartments4u system in the amount of the advance payment which the client transfers when making a reservation of the accommodation facility. Apartments4u accepts the commission when making a reservation and for the remaining part of the settlement the responsibility lies within the sides of the agreement that is the clients and owners of the apartments. Apartments4u does not impose any charges on the clients for the use of the Apartments4u reservation system.
  10. The use of the Apartments4u system is allowed only in accordance with the guidelines of this Rules and Regulations and only for purposes related to presentation and reservation of accommodation facilities. It is forbidden to collect and copy the data contained in the system and public viewing of the Apartments4u system without the consent of the Apartments4u. It is not allowed to use any IT tools used for getting and collecting data from the Apartments4u system without a prior written consent of the Apartments4u. The exception to this rule are general web browsers and non-commercial public archives using IT tools of getting data only for the presentation of links to the Apartments4u system. The term general web browser does not include websites and browsers specializing in the presentation of offers of renting of the accommodation facilities and similar, that are dealing with any renting of the accommodation facility.
  11. The owners and caretakers of the accommodation facilities putting their rent offer in the Apartments4u system declare that in accordance with valid provisions they are able to conclude binding rent agreements of their accommodation facilities.

III. Types of reservations

  1. Standard reservation – made by filling out a form with data and paying the advance payment for the Apartments4u through a DotPay integrated system of online payments. This reservation becomes a binding agreement between the client and the owner immediately after the receipt of the reservation status confirmed at the latest within 24 hours from the acceptance of reservation by the Apartments4u system. Up to that point, Apartments4u reserves a right to refuse the advance payment and its return to the client’s bank account as a result of circumstances beyond the Apartments4u’s control which made the finalization of the transaction unable.
  2.  Last Minute reservation – every reservation made no earlier than 48 hours prior to the beginning of renting the accommodation facility. When such reservation is made, the client can offer a possible Last Minute discount, the information of which is to be found in the accommodation facility’s description. The Last Minute reservation requires a telephone confirmation to the owner of the accommodation facility up to 2 hours from its making. If a reservation is made after 22.00 it should be confirmed till 11.00 the following day. The lack of telephone confirmation of the Last Minute reservation is tantamount to its cancellation by the client.
  3. First Minute reservation – each reservation made at least 100 days before the start date of renting the accommodation facility. The owner may offer a First Minute discount, the information concerning which is to be found in the description of the accommodation facility.

NOTE: Each reservation accepted by the Apartments4u system is immediately confirmed by a proper email sent both to the client and the owner.

IV. Payments, prices, additions, discounts and invoices

  1. The only accepted currency in the Apartments4u system is Polish Zloty (PLN). Prices given in other currencies are only approximate prices based on the daily currency calculation in accordance with the exchange rate on the date of making the reservation. Prices given in the Apartments4u system always include VAT in accordance with the valid tariff.
  2. Prices contained in the Apartments4u system may be given per 1 person only or for a whole accommodation facility for 1 night with the exact indication which type of price is given.
  3. Apartments4u does not collect any hidden or additional fees from the client for reservations made in the Apartments4u system.
  4. The total reservation price includes the payment for the utilities and cleaning after checking out. The owner cannot collect any hidden or additional payments on account of the reservation except those mentioned in the information of the accommodation facility.
  5. For the use of any additional services during one’s stay at the accommodation facility not mentioned in the original reservation, the client shall pay the owner before checking out.
  6. It is the client’s duty to pay all local health resort taxes determined by the local authorities. The information on such obligation is to be found in the description of every accommodation facility.
  7. The payments collected when making reservations are serviced by the DotPay internet service. The current information concerning possible forms of payment is to be found on the Aparments4u.pl system’s website.
  8. The procedure of making reservations is the following: upon the filling in of necessary information fields in the reservation form the amount of the advance payment is automatically authorized by the DotPay system through an encoded connection. Apartments4u may block the amount of the advance payment until the receipt of the reservation by the owner, maximum up to 48 hours beginning from the date of the payment authorization.
  9. When the client is using a credit card as a form of payment, the means will be blocked  on the client’s bank account at the time of the confirmation of making the reservation by the Apartments4u system.
  10. Apartments4u can reject the reservation if the means on the bank account are not sufficient to cover the amount of the advance payment or when during the authorization of the payment, there was its refusal.
  11. If a client cancels a reservation, the advance payment collected by the Apartments4u is not subject to return.
  12. Apartments4u has a right to issue a VAT invoice to the client only for the amount of the collected advance payment within 14 working days from the date of making a reservation. The client has a right to receive a VAT invoice or a receipt for the remaining amount of reservation from the owner of the accommodation facility. If the client does no provide all information necessary to issue an invoice or provides information that is not true, the Apartments4u will not be able to issue a VAT invoice after 14 days from the date of making a reservation.
  13. The client authorizes the Apartments4u to issue a VAT invoice in an electronic form without his/her signature as a recipient.
  14. The owner has a right to change the price of its accommodation facility given in the information in the Apartments4u system at any time without giving a reason. At the same time, the Apartments4u confirms that the price given to the client while making a reservation is a price the client has to pay for the service.
  15. The owner or the caretaker has a right to demand from the client the deposit when checking in, securing him/her from potential damages made from the fault of the client. For every damage made by or from the fault of the client, the owner or the caretaker has a right to keep an amount of the deposit equals to the amount of the estimated cost of repairing the damage. The information as to whether the deposit is required is to be found in the description of every accommodation facility in the Apartments4u system.
  16. The client does not have to count as an additional person a small child of up to 5 years of age if it does not need a separate accommodation place or additional bedclothes. One has to check also in the description of the accommodation facility whether it is adapted for children.
  17. The owner may offer a First Minute or Last Minute discount or a Special Offer, the information on such bargains is always found in the description of a certain accommodation facility and it is also considered in the algorithm of calculation of the total price of reservation.

V. Basic rights and duties of the users and the system administrator

  1. The owner is responsible for the contents of the description of his/her accommodation facility as well as its actual condition. The Apartments4u, not having a direct influence on the data of the accommodation facility entered into the system by the owner, does not bear responsibility for the inconsistency of the description with the actual condition of the accommodation facility.
  2. While making every effort so that the services provided by the Apartments4u system are on the highest level, Apartments4u system shall thoroughly monitor information in the surveys completed by the clients in order to eliminate all flaws in the system as well as taking appropriate measures towards the dishonest owners.
  3.  The administrator is not able to fully control the information placed both by the owners and the clients however he reserves himself a right to delete the contents that are not in accordance with or infringe the policy of the Aparments4u.pl. For all information entered by the owner, the caretaker of the facility and the client, the responsibility is taken in turn by those subjects.
  4. Only this client who has already been residing at a certain accommodation facility has a right to provide testimonials on the certain facility and he/she shall give an honest commentary. The email address of the person giving the commentary is available to the system administrator and the owner or the caretaker of the accommodation facility.
  5. The client shall leave the accommodation facility clean as it was before he took it. It is the client’s duty to obey good neighbourhood practices during his/her stay in particular he/she should not infringe the valid norms of observing the quiet hours.
  6. Due to safety reasons the owner has a right to introduce limits as far as the acceptance of large groups to his/her accommodation facility is concerned, in particular it relates to groups of the same sex. Such information is to be found in the description of every accommodation facility in the Apartments4u system.
  7. Apartments4u system has a right to change the appearance, graphic layout and functionality of the Apartments4u system.

 VI. Stay

  1. The hotel day is specified in the description of every accommodation facility found in the Apartments4u system.
  2. After making a reservation, the Apartments4u sends the client via email a voucher containing all necessary data and information enabling further contact with the owner or the caretaker of the accommodation facility in order to set the details concerning the takeover of keys, checking in and checking out of the accommodation facility.
  3. The client shall consult the owner or the caretaker of the facility via telephone or email in order to determine the details of the receipt of keys no later than 24 hours before the arrival.
  4. The client shall inform the owner or the caretaker of the facility by phone that he/she might be late to the earlier agreed meeting.
  5. The number of persons that are able to live in the apartment is specified in the reservation in the binding way. It can be changed by sending a proper message via email to: booking@Apartments4u provided that the conditions of a certain accommodation facility allow it.
  6. The owner or the caretaker of the facility has a right not to handout the keys to the accommodation facility if the number of persons exceeds the number given in the reservation. If during a check out it turns out that there were more persons than agreed, the owner or the caretaker of the facility has a right to charge the client for an additional person or, if it is not possible, a charge in the amount of 30% of the total reservation price applies.

 VII. Complaints and responsibility

  1.  All complaints concerning the stay in the accommodation facility should be first of all directed to the owner or the caretaker of the accommodation facility on the day of the departure. If the client thinks that the complaint has not been investigated properly, he/she should send it also to the Apartments4u system within 48 hours from leaving the accommodation facility to the email address: info@Apartments4u
  2. Apartments4u shall investigate all complaints within 14 days from the date of its receipt.
  3. The client bears all financial responsibility for damages made by him/her or resulting from his fault in the accommodation facility, in which he/she was living and at the same time he/she shall inform the owner or the caretaker of the accommodation facility of any faults or damages immediately after they are done regardless of the cause.
  4. The Apartments4u does not bear responsibility for damages done to the client by the owner or the caretaker of the accommodation facility. Apartments4u does not also bear responsibility for possible injury during one’s stay in the accommodation facility. The client declares that he/she has a proper insurance covering the period in which he/she was staying in an accommodation facility and securing the covering of costs in the situation of potential accident.
  5. The Apartments4u does not bear responsibility for any inconveniences or troubles occurring during the client’s stay in the reserved accommodation facility caused by the electricity, gas and water cut or other conservation or repair works of the devices being a part of the equipment of the accommodation facility as well as for the faulty operation of these devices.
  6. Apartments4u is absolved of any legal and financial responsibility in the situation of conflict between the system users both owners and clients. In such situations, financial and legal claims cannot be directed to the Apartments4u.
  7. The whole financial responsibility of the Apartments4u in the case of a justified claim is a limited amount of the advance payment paid by the client and any financial demands cannot exceed this value.
  8. Apartments4u reserves a right to delete the offers of renting the accommodation facilities if their character will not correspond with the marketing policy of the Apartments4u and also when there will be a breach of rules and regulations. The Apartments4u can delete offers if the owners or the caretakers of those accommodation facilities break the rules of fair conduct generally accepted in the tourism and tourist renting of accommodation facilities or the assessments issued by the clients are very low and this is a permanent situation.

 VIII. Changes and transfer of rights

  1. The client shall pay the full amount due to the owner as a result of the confirmation of reservation even when for reasons he does not bear responsibility for, the period of reservation is shortened or he/she would like to change the conditions of reservation upon the arrival to those that are less advantageous for the owner.
  2. The client may change the number of days of his/her reservation by making another reservation provided that the dates the client would like to prolong his/her stay are available.
  3. The client may change the reservation date while keeping the reservation length provided that the availability of the accommodation facility will allow it. In order to do so one has to request for a change of the date and it should be sent to the owner or the caretaker of the accommodation facility via email. It can result in a complete change of the total reservation price due to possible differences in prices resulting from dates assigned to various reservation seasons.
  4. The client has a right to transfer all rights resulting from the reservation made for another person, at the same time this person assumes all duties resulting from the reservation made. The condition of such transfer of a right is sending a proper information with all necessary details of the person taking over the rights and duties of the reservation to the Apartments4u system via email to booking@Apartments4u no later than within 24 hours before checking-in in the accommodation facility (all data necessary to filling the registration form should be sent).
  5. The cancellation of reservation and full return of the advance payment is only possible when a person is seriously ill and is not able to arrive or he/she is dead. A copy of a proper medical certificate is required.

IX. Exceptional circumstances

  1. When making of an original reservation is not possible, the Apartments4u informs the client about the existing situation and will offer an alternative accommodation facility of the most similar standard to the one chosen in the original reservation. The client may not accept this solution and then the Apartments4u will return the client the full amount of the advance payment. When it is not possible to complete the reservation, the client cannot lay any financial claims to the Apartments4u except the return of the incurred costs of the advance payment.
  2. Apartments4u, in the case of occurrences of force majeure, reserves a right to cancel the reservation without bearing any responsibility for the default of the agreement. It also concerns the situation when a personal safety of the client or his/her possessions cannot be guaranteed for reasons the Apartments4u cannot bear any responsibility for. In such situation, the client will receive the return of the advance payment.

X. Personal Data Protection

  1. Apartments4u attaches a lot of weight to ensuring that its clients have a proper protection of their privacy. Being an administrator of the reservation system it puts an emphasis on the protection of all personal data in the Apartments4u system against an unauthorized access to them. All personal data found in our reservation system are processed in accordance with the Art. 23 section 1 points 1, 3 and 5 of the Personal Data Protection Act for purposes related to running a commercial activity.
  2. Every client and the owner of the accommodation facility agree for his/her personal data to be processed in the Apartments4u system for the purposes of realization of the reservation and the presentation of offers of the renting of the accommodation facility.
  3. The clients’ personal data will be transferred to the owners or the caretakers of the accommodation facility only for the purposes relating to the realization of a reservation. The owners and caretakers of the accommodation facilities shall not use all personal data obtained, in particular email addresses, for purposes other than those relating to the realization of a reservation.
  4. Personal data necessary for the realization of payment are transferred to the DotPay service where they are being processed in accordance with rules and regulations of the online DotPay system.
  5. All users accept the fact that the communication with the Apartments4u system is open and because of this the elements of communication with the Apartments4u may be read or took over by unauthorized persons.

XI. Copyrights

  1. All information, photos and illustrations as well as all remaining contents of the Apartments4u system may be used for private, non-commercial use. All contents of the system as well as the Apartments4u system itself are copyright. Copying or storing of elements downloaded from the Apartments4u system for purposes other than private and non-commercial is strictly forbidden without the consent of the Apartments4u and other owners of the copyright of certain elements.
  2. The owners and caretakers of the accommodation facilities declare that they have copyright to all materials placed by them in the Apartments4u system, in particular photos, and at the same time they certify that the photos are accurate depictions of the reality so as not to mislead the potential client. The owner or the caretaker of the accommodation facility declares that he/she is authorized to have the copyrights to the placed materials with its transfer to the Apartments4u. It is the owner or the caretaker of the accommodation facility who should gain those rights.
  3. The owner or the caretaker of the accommodation facility who put their offer in the Apartments4u system give their consent for unlimited and free of charge use of placed materials including its modification, publication and presentation in the world wide web. At the same time they agree that the Apartments4u system restricts and copyrights those materials in order to limit their unlawful use by other subjects.

 XII. Applicable law

  1. For all potential disputes, the Polish law shall apply
  2. The disputes between the client and the owner will be settled by a proper court which has jurisdiction over the seat of the owner of the accommodation facility.
  3. The disputes in which one side will be the Apartments4u will be settled by a court having jurisdiction over the seat of the Apartments4u.
